CONSENT AND RELEASE FOR PHOTOS AND IMAGES
This CONSENT AND RELEASE is entered into the date entered below by the undersigned client (the “Client”) to and for the benefit of RISE Mind Body Fitness (the “Company”). In consideration of the Client’s participation in the Company’s activities, the Client hereby acknowledges, consents to, and agrees as follows:
1. Client hereby releases and discharges the Company from any liability which may arise from the use of Photographs including, without limitation, and liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form that may occur or be produced in the taking of said picture or in any processing thereof through completion of the finished product.
2. Client agrees that Client will not assert any claim or action against the Company or its successors, licenses or assigns or anyone designated by the Company to use the Client’s likeness on the grounds that anything performed therein or in the advertising, or publicity in connection therewith violates rights of privacy or violates any other rights. IN WITNESS THEREOF, the terms set forth above are hereby accepted on the date first written above.
3. 24 HOUR CANCELLATION POLICY: 24 hour notice prior to your scheduled appointment must be given to cancel your training appointment or your package will be charged a session. Rescheduled appointments with less than 24 hour notice must be rescheduled for the same day to save that session.
4. PACKAGE EXPIRATION/NON COMPETE/NON SOLICITATION:
1. Monthly services expire at the end of each month. A 12-pack has 7 weeks before expiration, and both the 36 and 48 packs have 18 weeks before they expire.
2. In the unlikely event that your trainer is no longer employed with RISE or if your trainer takes time off we will provide you with another trainer for the duration of your package and moving forward. All trainers undergo the same training for their onboarding to ensure the intergrity of our product and service. These packages are non refundable.
3. You may not, at any time, solicit your trainer or any other trainer or employee employed by RISE for any goods or services of any kind, including but not limited to: training, programming, another job, nutritional advice/ coaching, or other. If you are found to be in violation of this, you will be asked to stop training and will not be issued a refund for your remaining sessions.
